The Telephone Consumer Protection Act (TCPA)
Under the TCPA, companies are no longer allowed to:
- Call before 8:00am
- Call after 9:00pm
- Ignore your do-not-call request while you are on the phone
- Deny your access to their information by refusing to give their names, the companies they work for or a ways to contact that company again
- Auto-dial your cell phone or play pre-recorded messages
The law is supposed to restrict the number of unsolicited calls you get, either from live solicitors or from automated services. However, tax-exempt and non-profit groups are excluded from the TCPA, as are emergency calls; so are polling calls and market researchers, which is why so many people will be inundated with calls when election season rolls around.
Understanding the problem
Though these actions are illegal, it does not always stop unscrupulous telemarketers from robo-calling your house. That is because these companies face fines, but no real legal actions, if they continue to break the law. Scammers will continue to call you if they believe they can make more money from you than they might have to pay in fines, which usually fall between $500 and $1,500 per violation.
But all of this may be about to change because of a case in Texas. USA Today reports that “a federal judge has awarded a Texas woman nearly $230,000, saying a cable company harassed her with 153 robo-calls even after she complained about them.” That judge tripled the fine for each call – and other judges are sitting up and taking notice.
